All sales by Truffore made through this website are subject to the following Terms and Conditions of Sale. Before you place an order, you should carefully read these Terms and Conditions of Sale. By placing an order, you agree to be bound by these Terms and Conditions of Sale.
1. Contract
These Terms and Conditions of Sale are incorporated into all contracts of sale between you and Truffore, with its registered office at 860 Coronation Road, London, NW10 7PS. The products available for purchase on this website are supplied by Truffore.
2. Price
All prices and delivery costs displayed on the website are quoted in pounds sterling and are correct at the time of display. We reserve the right to change the current price of any goods ordered. However, in this instance, we shall notify you of such changes prior to dispatch of goods ordered, and you will have the opportunity to cancel your order if you wish.
3. Payment
Payment must be made at the time of order. You can pay by Visa, Visa Electron, Visa Debit, Maestro, Mastercard, and Solo. The holder of the credit or debit card used for the payment of goods purchased is fully liable for all sums charged. Completing the payment information and submitting the order implies authority to debit the relevant card. Truffore will take all reasonable care to keep your order and payment details secure; however, purchases from this website are at your own risk.
4. Passing of Title and Risk
Property and title in and to the goods ordered by you shall not pass to you until Truffore has received payment in full, in cleared funds, for the price of the goods, including all ancillary costs (to include the correct amount of delivery costs for the specific destination). Once this payment has been received, the goods will be dispatched to you. The goods shall be at your risk as soon as they reach the required destination, as confirmed by the purchaser on the order.
5. Availability
All goods ordered are subject to availability. Truffore reserves the right at any time to make changes to the specifications of the goods or to withdraw certain goods at any time without notice. While Truffore will make every effort to have adequate stock of goods available, occasionally we may not be able to fulfil your order. If we are unable to fulfil an order (in whole or in part), we will advise you of this either by email or phone. If we are unable to contact you, we reserve the right to dispatch the balance of your order minus the goods that are unavailable; in this case, the amount that you have paid relative to the missing goods will be refunded to the original form of payment used. Truffore reserves the right to discontinue supplies of goods at any time and excludes all liability in respect of any claim arising from you or any third party caused directly or indirectly by such discontinuance.
6. Formation of Contract
An order submitted by you via this website is deemed to be an offer to purchase goods from Truffore. No contract shall be formed between Truffore and you unless and until we dispatch the goods to you. We may at any time decline to accept your order for any reason. In this case, the amount paid will be refunded to the original form of payment used. All contracts will be deemed to have been concluded in England.
7. Delivery
Truffore will make all reasonable efforts to ensure that the products ordered (excluding fresh truffles) are dispatched to you within the timescales specified in our delivery section and will, in any event, deliver the goods ordered (if available) within thirty (30) days from the date of your order. You will be notified by phone or email if for any reason your purchase will not be dispatched within the specified timescale, in which case you will be entitled to cancel your order. While Truffore shall use reasonable endeavours to comply with specified delivery dates and will use reasonable endeavours to put right as quickly as reasonably practicable any failure by Truffore or their delivery contractors to deliver by specified delivery dates, Truffore shall not be liable for any failure to deliver by such dates or at all or for any loss or liability whatsoever and howsoever caused arising from such failure. If any duties, taxes, penalties, charges, or expenses are imposed or incurred as a result of any action by the customs authorities, it is the receiver’s responsibility to pay the amount in question. If we are requested to deliver to an alternative address or location, the goods will be left at this alternative address or location at your own risk.
8. Cancellation & Returns
If you are unhappy with your online purchase, you have the right to cancel your order by giving written notice to us by email, or post at the address given below within fourteen (14) days of receipt of your order. If you cancel your order following dispatch of the goods, you must also return the goods to Truffore and we will then refund your credit or debit card the cost of the goods ordered within fourteen (14) days of receipt of the returned goods. The cost of returning the goods will be at your expense. On such cancellation, Truffore shall accept such goods only if they are returned to Truffore in the same condition as the originally delivered goods. Unless there was an error on the part of Truffore in dispatching an order, or the goods were of unsatisfactory quality, or the goods supplied were alternative goods supplied by Truffore, the refund shall be exclusive of delivery or any other ancillary charges. If you do not return the goods within fourteen (14) days of your cancellation, we will make a charge in respect of recovering the goods. If you do not return the goods or fail to make them available for collection within twenty-one (21) days of your notice of cancellation, you will be deemed to have accepted the goods and you will be liable to pay for such goods. All our goods are guaranteed to comply with all statutory requirements and regulations relating to the sale of food.
9. Damaged and Defective Goods
If the goods you receive are damaged, defective, or different from the goods ordered, you will be entitled to a full refund. You should inform Truffore of the damaged, defective, or dissimilar nature of the goods delivered either by email at sales@laquila.co.uk, or in writing to Truffore, 860 Coronation Road, NW10 7PS, London, UK, within twenty-four (24) hours of receipt of the goods. The reasonable cost of returning the damaged, defective, or dissimilar goods shall be at the expense of Truffore. If you do not notify Truffore of the damaged, defective, or dissimilar nature of the goods within the above-set timescale, you shall be deemed to have accepted the goods and shall not be entitled to reject the goods, and Truffore shall have no liability for such damage or defect. Where any valid claim relating to any defect in the quality or condition of the goods is notified to Truffore in accordance with these Terms and Conditions of Sale, Truffore shall replace the goods free of charge or offer you a full refund together with any reasonable costs incurred in returning the goods, but Truffore shall have no further liability to you. THE SPECIFIED WEIGHT OF A FRESH TRUFFLE IS ITS WEIGHT AT THE TIME IT WAS HARVESTED. ONCE OUT OF THE GROUND, TRUFFLES LOSE APPROXIMATELY 2 TO 5% OF THEIR WEIGHT EVERY 24 HOURS. THIS IS DUE TO THEM BEING REMOVED FROM THEIR DAMP ENVIRONMENT UNDER THE GROUND AND SUFFERING WHAT’S CALLED MOISTURE LOSS. WHITE TRUFFLE AUCTION SHALL HAVE NO LIABILITY FOR THE NATURAL PROCESS OF WEIGHT REDUCTION OF FRESH TRUFFLES CAUSED THROUGH MOISTURE LOSS.
10. Return Address
All returns must be sent to Truffore, 860 Coronation Road, NW10 7PS, London, UK.
11. Warranties
To the fullest extent permitted by applicable law, Truffore disclaims all warranties, representations, and undertakings whatsoever, express or implied, specifically including but not limited to warranties of satisfactory quality or fitness for a particular purpose. This does not affect your statutory rights as a consumer.
12. Force Majeure
Truffore shall not be liable for any delay or default in the execution of its obligations in the case of any event outside its control, including but not limited to natural disasters, bad or inclement weather, fires, explosions, floods, failure or delay of third-party suppliers, computer or software errors, national or local strikes or stoppages, accidents, riots, or civil uprisings.
13. Your Rights
All the foregoing provisions do not affect your statutory rights as a consumer.
14. General
If any provision of these Terms and Conditions of Sale is determined to be illegal, void, or unenforceable by any court or administrative body of competent jurisdiction, such determination or decision shall not affect the other provisions of these Terms and Conditions of Sale, which shall remain in full force and effect. Truffore reserves the right to vary these terms and conditions at any time prior to accepting any order from you. The Terms and Conditions of Sale shall be governed by and construed in accordance with English law. Any dispute arising out of or in connection with these Terms and Conditions of Sale shall be subject to the exclusive jurisdiction of the English Courts.
